TERMS & CONDITION

These terms and conditions form a legally binding agreement between you ("Customer", "you", or "your") and Skips.com.au ("we", "us", or "our").

By accepting a quote, receiving a skip delivery, or signing a tax invoice, you agree to these terms.

1. Definitions

To keep things clear, here are some key terms:

Account: Your approved credit account with us.

Additional Fees: Extra charges that may apply, such as:

  • Overfilling the skip or loading it improperly.

  • Excess to agreed weight limit for bin.

  • Putting in waste types not listed in the quote.

  • Keeping the skip longer than agreed.

  • Council fees, fines or other penalties due to misuse.

  • Any other costs incurred from not following this agreement.

Agreement: These terms plus the quote and any other document we issue to you.

Bin/Skip: The waste container(s) we provide.

Charges: All amounts you owe us for our services.

Claim: Any legal or financial demand.

Collection: When we pick up your skip.

Credit Card: Any card details you provide for payments.

Dispute: A disagreement about our services.

Damages: Losses or costs, including legal fees.

Equipment: Everything we use to provide services (e.g., skips, trucks,).

Fees: All charges stated in the quote or these terms.

GST: Goods and Services Tax.

Insolvency Event: Bankruptcy or external administration.

Law: Any applicable laws or regulations.

Quote: Our price and service details given to you.

Site: Where the skip is delivered or picked up.

Skip Services: The services you requested from us.

Terms: These conditions plus any details in our quote, invoice, website or communications.

Waste: What you put in the skip.

2. Our Services

We will provide skip bin services as outlined in the quote, subject to availability and safety.

You acknowledge:

  • We do our best to deliver and collect on time, but issues outside our control (like weather or road access) may cause delays.

  • You or someone you authorise may be asked to sign for delivery or collection.

  • We may refuse service if there are safety concerns or unpaid charges.

  • We can inspect your waste and may refuse to take it if it’s not as agreed or contains prohibited materials.

  • You’re responsible for arranging special pickups for hazardous or restricted items.

  • Once we collect your skip, we take ownership of its contents (unless it contains excluded waste).

  • Bins are not to be filled above the rim – nothing is to protrude above the rim at all. If bin is overfilled, we retain the right to remove items as necessary to make it legal to transport. These items will be placed next to or near the bin. If this is not possible to do for whatever reason, we may tip the contents of the bin back onto your property without a refund of any kind. In such case we are not liable for any damage incurred to your property or belongings.

  • If a skip bin exceeds its weight limit, the customer will be charged the lesser of the excess weight fee or the cost to upgrade to the correct waste type. Any additional charges will be automatically applied to the credit/debit card used for payment.

  • Unsuccessful delivery or collection attempts caused by factors outside skips.com.au’s control will incur a minimum fee of $180 per attempt.

  • If a chargeback is initiated for any payment to skips.com.au, the waste may be returned to your property.

  • If any prohibited waste is loaded into the bin and required the bin to be cleaned eg. food waste or paint etc, a cleaning fee will be payable.

  • If collection is attempted and the customer requests a reschedule, a minimum call-out fee of $180 per bin will apply.

  • A council permit may be required to place a skip bin on council land, including nature strips and roads. Please check with your local council before delivery. Customers are responsible for any fines if a permit is not obtained.

  • If we arrive to deliver and you request placement on council land without a permit, then reject delivery, a minimum $180 call-out fee per bin will apply.

  • Once delivered, the skip bin must not be moved. If moved, we accept no liability for any damage to your property or vehicles in recovery of the bin.

  • If the bin’s new position causes damage, you will also be liable for any recovery fees and associated costs for any damages.

  • Please ensure clear access to the skip bin drop-off and pick-up location on the scheduled day. The truck must reverse into the same position for collection as it did for delivery.

  • Skips.com.au accepts no responsibility for any property damage during delivery or collection, including but not limited to grass, driveways, gardens, trees, or carports. Bins will be placed in the safest location at the driver's discretion. If you request an alternative placement, you assume all risk and liability for any resulting damage to your property or council property.

3. Fees and Payment

  • Our prices are valid for 30 days from the quote unless stated otherwise.

  • You must pay all charges by the due date on your invoice or as otherwise directed.

  • We may charge your credit card or debit your bank account for unpaid amounts.

  • If you request service outside of normal schedules, extra fees may apply.

  • All charges include GST. GST is included in the quoted price.

  • If a customer requests a different bin size after delivery, a minimum $180 fee plus the size upgrade cost will apply to collect the original bin and deliver the new one.

  • All additional fees (e.g., extra, excess, futile, demurrage,) will be charged to your credit/debit card without prior verbal notice. A receipt will be emailed or mailed after the charge. Damage to our equipment, due to incorrect use or other, will result in charges to reinstate the equipment.

  • We can raise our prices by giving you 30 days’ notice if you are an account holder. You can cancel the agreement before the new prices apply.

  • Overdue payments incur daily interest (2% above current reserve bank rates) and recovery costs.

4. GST and Government Charges

All prices include GST unless noted. You must cover any applicable taxes or levies related to our services.

5. Cancelling or Changing Services

Cancellation Policy:

Once an order is received, cancellations will incur the following fees:

(a) Before 4:30 p.m. the day prior to delivery – 10% of the total invoice

(b) After 4:30 p.m. the day prior to delivery – $180.00 fee.

You can cancel if:

  • We break a major term and do not fix it within 14 days.

  • We go into insolvency.

  • You reject a price increase.

If you cancel early without a valid reason, or if we cancel because of your breach, we may charge early termination fees to cover our costs.

On cancellation, all unpaid charges become due immediately.

6. Your Responsibilities

  • Follow all relevant laws.

  • Cooperate with our staff and follow our instructions.

  • Keep the equipment safe and clean.

  • Don’t damage or misuse our skips.

  • Make sure we can access the skip when scheduled.

  • Give us all necessary information about the waste you’re disposing of.

  • Our bins remain our property—don’t sell or modify them.

7. Missed Deliveries

If we cannot deliver on the agreed date due to issues on your end, we will either reschedule or refund at our discretion.

8. Our Warranty

We will provide our services with reasonable care and professionalism.

9. Your Indemnity

You agree to cover us for any damage or legal claims resulting from your misuse of our services or breach of this agreement.

10. No Guarantees Outside the Contract

You confirm that you have not relied on any promises outside of this document or our quote.

11. Limiting Our Liability

We are not liable for any indirect or business-related losses. Our liability for other losses is capped at the total amount you have paid us.

12. Risk and Ownership

You are responsible for the skip while it is in your possession. The skip always remains our property.

13. Resolving Disputes

Before going to court, both parties agree to try resolving any issues in good faith through mediation.

14. Ending the Agreement

We can cancel the agreement if:

  • You breach the terms and do not fix it within 14 days.

  • You fail to pay what you owe.

  • You become insolvent.

We may retrieve our skip at any time upon termination.

15. Privacy

We manage your data according to our Privacy Policy at skips.com.au.

16. Force Majeure

We are not liable if unexpected events outside our control prevent us from delivering services. If it lasts more than 7 days, we or you may cancel the agreement.

17. Updates to These Terms

We can change these terms anytime. Updated terms apply to any future bookings.

18. Severability

If part of this agreement is found to be invalid, the rest still applies.

19. Waiver

If we do not enforce part of this agreement, it does not mean we waive our rights to enforce it later.

20. Notices

All notices must be in writing and sent by hand, post, or email.

21. Surviving Terms

Sections about fees, liability, warranties, disputes, and privacy continue even after the agreement ends.

22. Governing Law

This agreement is governed by the laws of Victoria, Australia. All disputes will be addressed in Victorian courts.
